A Reddit moderator referred to as “KlammereFyr” has recently been found guilty by a Danish court following the clipping and distribution of numerous nude scenes filmed by actresses for films and TV series, which they seemingly did not anticipate being shared out of context.
According to TorrentFreak reported, many actresses expressed their dissatisfaction regarding the moderator’s sub-reddit, “SeDetForPlottet” (WatchItForthePlot), with some stating they felt “molested or abused.”
In response, Danish police were urged by the Rights Alliance—representing the Danish Actors’ Association, two broadcasters, and various rightsholders—to shut down the forum and initiate a criminal investigation.
The organizations contended that KlammereFyr stripped away the artistic context and immorally sexualized performers by sometimes cropping scenes or “adjusting the lighting to highlight specific features,” as reported by TorrentFreak.
For these groups, it appeared evident that KlammereFyr was breaching a seldom-enforced segment of copyright legislation that safeguards artists’ “integrity” by protecting their “moral rights.”
In Denmark, the “right of integrity” stipulates that even when individuals are permitted to utilize a work, they are not allowed to alter it or use it in a manner or context that compromises the author’s literary or artistic reputation or distinctiveness, as noted by a resource for Danish researchers.
Ultimately, a now 40-year-old individual was charged after admitting to infringing moral rights through the sharing of no fewer than 347 clips featuring over 100 actresses, which a Danish outlet reported garnered 4.2 million views. He also faced charges for distributing over 25 terabytes of pirated material via a private torrent tracker known as Superbits.org, according to TorrentFreak.
Following his admission, the Court of Frederiksberg found the Redditor guilty, imposing a seven-month conditional prison term, along with 120 hours of community service. Subsequently, the Reddit moderator will confront a distinct civil lawsuit to determine damages, which could be significant. Rightsholders are demanding between $2,300–$4,600 per nude clip, as reported by TorrentFreak, suggesting the maximum potential compensation could exceed $1.5 million.
Pivotal case may shape the US perspective on “moral rights”
The conviction marks the “first criminal conviction” grounded in the Danish copyright law’s “right of respect,” as reported by TorrentFreak. In a statement, special prosecutor Jan Østergaard commended the court for addressing the matter with seriousness.
